Eugene ENT Files Appeal Against Court Ruling Voiding Approval of Its Acquisition of YTN Shares

[Alpha Biz= Paul Lee] Eugene ENT announced on December 4 that it has filed an appeal with the Seoul High Court after a lower court canceled the Broadcasting Communications Commission’s (KCC) approval of the company becoming YTN’s largest shareholder. The first-instance ruling determined that the approval process was procedurally flawed because the KCC had operated with only two commissioners at the time the decision was made.

Eugene ENT argued that legal interpretations regarding the KCC’s two-member structure have been inconsistent across multiple related cases, noting that several first- and second-instance rulings have reached differing conclusions. The company also cited a recent Seoul High Court decision in another KCC-related case, which concluded that a two-member vote was not procedurally unlawful.

Given these evolving legal precedents, Eugene ENT said it has decided to proceed with the appeal, stressing that the matter requires clarification at the appellate level.
