Samsung Files Preemptive Lawsuit Against Netlist Over HBM Patent Dispute

[Alpha Biz= Paul Lee] Samsung Electronics has initiated a legal battle with U.S.-based patent assertion entity Netlist over high bandwidth memory (HBM) technology, marking a new front in the long-running dispute between the two companies. As Netlist filed a patent infringement lawsuit in the U.S. District Court for the Eastern District of Texas, claiming that Samsung infringed on its HBM-related intellectual property, Samsung responded by filing a declaratory judgment action asserting non-infringement.



According to court documents released on May 27 from the U.S. District Court for the District of Delaware, Samsung filed the lawsuit on May 20 to seek confirmation that it did not infringe Netlist’s U.S. Patent No. 12,308,087, which relates to the stacking of DRAM dies—an essential technology for HBM.



Just a day prior, Netlist filed its own lawsuit in the Eastern District of Texas, a jurisdiction known for its plaintiff-friendly stance on patent disputes, especially those involving foreign corporations.



“This lawsuit stems from Netlist’s repeated claims of patent infringement against Samsung,” the company stated in its filing. “Samsung seeks a declaratory judgment that it does not infringe the ’087 patent.” The company also emphasized that “Netlist attempted to assert infringement against Samsung even before the patent in question was formally issued.”



The conflict between Samsung and Netlist, which has spanned several years and involved multiple memory-related patent disputes, appears to have entered a new phase amid surging demand for HBM fueled by the global AI boom.
